Busey Wealth Management is responsible for administering the Trust Services offered through Busey Trust Company. It is a complex responsibility requiring the services of highly trained and experienced Trust Professionals whose duty is to protect, in many cases, family wealth set aside for minors, elderly, incapacitated family members or future generations. Busey Trust Professionals take direction based on the trust agreement, which is a legal document between two parties. Often times those parties include the family member establishing the trust and the trustee, such as Busey Trust, that manages the assets placed in trust for the benefit of a beneficiary through our wealth management group.

 
WHAT IS A TRUST?  

A trust is a legal agreement whereby you transfer assets to the trust to be managed by a trustee. The trustee administers the trust and manages the assets for your benefit or for the benefit of others.

 
 
WHY SHOULD YOU CONSIDER A TRUST?  
A trust is a private document, not a public document like a will
A trust can continue after death, avoiding the public process and cost of probate
A trust provides ongoing estate planning opportunities and can reduce estate taxes
A trust allows for unification of your assets and assures continuing management of your assets for your family and other beneficiaries

Living Trust
Self-Declaration (Standby Trust)

LIVING TRUST  

A trust you create during your lifetime, usually for your benefit. Your living trust provides privacy and management of assets. You may change your trust provisions as your needs change.

 
 
SELF-DECLARATION OR STANDBY TRUST  

A living trust where you are the trustee. You act as the trustee for as long as you desire or are able to act. You name your successor to take over as trustee when you are no longer the trustee.

A Self-Declaration Trust may be a better alternative to transfer your assets than a will because it is not filed with the Probate Court. The assets of the trust and their disposition remain private.

 
 
TESTAMENTARY TRUST  

A trust created by the provisions of your will. Your spouse and family are provided for without the responsibility of managing their inheritance. A testamentary trust can provide a tax advantage by reducing estate taxes at death. It may also be used to provide support to your favorite charities.

 
 
SPECIALIZED TRUSTS  

Your specific needs and those of your family may be provided for by the use of a specialized trust. These trusts can deal with charitable gifts, minor children, insurance, or those with special needs. Discussion of these trusts should take place with your attorney and financial planner.

 
 
ESTATE ADMINISTRATION  

Your Executor is charged with the responsibility of carrying out your wishes as expressed by the terms of your will. The selection of your Executor is important and should not be taken lightly. Your Executor should have the experience and the expertise to handle the complexities involved in settling an estate. Estate administration is time consuming and involves interacting with attorneys, accountants, beneficiaries, and grieving family members.

The actual administration of your Estate includes:

 
Locating and protecting all of the Estate's assets
Valuing all of the assets as of the date of death
Managing cash, stocks and bonds
Managing real estate and other special assets
Paying the debts and expenses of the Estate
Investigating and obtaining retirement plan benefits
Analyzing available strategies to further minimize taxes
Coordinating information for preparation of the final personal income tax returns and the Estate tax return
Preparing detailed accounting reports
Preparing reports as required by the court
Arranging for the distribution of assets, including marital and family trusts, after settlement of the estate
